Constitution of Special Courts under Odisha Lokayukta Act

Constitution of Special Courts to hear and decide the
cases   to be filed by the  Lokayukta 
for  prosecution

As per 
section 35  of the  Odisha Lokayukta Act, 2014, the  State 
Government  shall constitute  such number 
of special courts  as  recommended 
by the  Lokayukta  to hear 
and decide the  cases arising  out of the 
Prevention of Corruption Act , 1988  
or  under this  Act.

 In view 
of  this  provision, RTI  Application was  filed 
to the  PIO, Dept. of  GA&PG, Govt. of Odisha  seeking 
the  following  information.

 i. Copy of recommendation made by Lokayukta, Odisha
for constitution of Special courts under section 35 of Odisha Lokayukta Act,
2014

ii. Provide copy of notification, if any made for
constitution of Special Courts for trail of  cases referred by Lokayukta, Odisha

 On 13^th April 2021,  the PIO 
has  provided  the  
information as follows.

1.      On 16.7.20, 
the  office  of Lokayukta 
has sent  to the Principal  Secretary, GA&PG Department , Govt. of
Odisha  a letter  of recommendation to constitute  all the 
courts (  as mentioned below)  established 
under  section 3 91) of the
Prevention  of Corruption Act , 1988  and under section 3  of 
the  Odsiha Special Courts  Act, 2006 , as  Special  Courts   under 
section 35 (1)  of the Odisha
Lokayukta Act , 2014 to hear  and
decide  the cases  arising out 
of the   Prevention of Corruption Act, 1988 or  the 
Odisha Lokayukta Act, 2014.

 2.     Following  recommendation  of the 
Lokayukta, Odisha , the   Home ( Special section) Department  in Govt. of Odisha   made a
notification  dt. 17.11.20   designating the  following  Courts 
as Special  Courts to hear  and decide 
the cases  arising out  of the 
 Prevention of Corruption Act,
1988 or  the  Odisha Lokayukta Act, 2014.
